What do I have to do to get a tax refund?

1. As the property owner you need to apply for a NIP number (tax identification number).

2. Before signing the contract with a developer, you have to register in the appropriate tax office as an active VAT payer (with the VAT-R form) and provide your NIP number.

3. Once you buy the property, you need to file the VAT-7 and JPK-VAT declarations where you state the output tax and input tax.

You will receive the tax refund within 15 to 180 days from filing your VAT declaration for the period when you applied for the refund.

You must state the act of buying the property in the VAT declaration in the month/period when you received documents confirming the transaction, however no later than the end of the third month after you received the invoice.

The property must be used for a taxable activity, e.g. rental.

Will I be able to get a loan for a rental property?

Most banks will not grant you a mortgage in this case, but rather an investment loan. They may also require some kind of collateral. Each bank offers different credit options and only these institutions can provide you with binding information on this matter.

Can I use the investment apartment myself and live there?

You cannot register as a resident in such an apartment, but you can use it yourself.

Do I need to run a business to rent my investment apartment?

No, you don't need to be a business owner to rent a property and pay the income tax for renting it.
